These services are available to any user, for their own consumption and subject to the following terms and conditions: these Conditions of Use and Contract, our Privacy Policy and Cookies Policy, which will also always be available at the foot of the online site and not It must be used for illegal purposes or in a way other than what is contemplated therein.

When you use the Service, you agree to our terms and conditions and thereby agree not to use the Service for illegal purposes.

3.- Description of the Service

Through the Service, RCD Mallorca allows the purchase of official Real Club Deportivo Mallorca products such as kits, sportswear for training sessions, caps, merchandising, scarves or children's club products, among others. 

The language in which the contract between RCD Mallorca and the buyer will be concluded will be Spanish.

 

The purchase process in the online store will be as follows:

• Within the web appears the product catalog divided into categories so that you can select the desired product.

• After making the selection of the product, it will be included in the shopping cart. At that time you can continue buying more products or go through the checkout.

• Once the selection is completed, you will proceed to fill in your personal data, the billing address, the delivery system and the payment method. You can also add discount codes and a comment about your order.

• In the last phase, a summary of the items purchased, payment method, delivery method, acceptance of the terms and conditions of the Service and the button to confirm the purchase will be presented. 

The purchase formalization document will be stored in your profile for consultation. In any case, you can always request it at onlineshop@rcdmallorca.es

During the purchase process you will be able to modify the number of units, change the delivery and billing addresses, the payment method and the delivery system. To do this, you must go back on the corresponding button when possible and before the final acceptance of the sale. 

Once the sale is made, it will be confirmed by sending an email, within a maximum period of 24 hours, to the address you have indicated. It will indicate the product purchased, its amount, applicable taxes, shipping costs, the form of payment, the place and delivery time and the applicable terms and conditions.

You may be sent from the Service to other websites through links. However,RCD Mallorca does not control those sites or their content, which are in fact subject to their own terms and conditions. Therefore, RCD Mallorca is not responsible for the quality, veracity or accuracy of these sites.

5.- Age

Regarding the use of the Service, you declare that you are of legal age and that you have the necessary legal capacity to be bound by this agreement and use it in accordance with its terms and conditions, which you fully understand and acknowledge.

You declare that all the information you provide to access the Service, before and during its use, is true, complete and accurate.

6.- Intellectual and industrial property

6.1.- Own content

The content and information of the Service (including graphic design, source code, logos, texts, graphics, illustrations, photographs, trade names and any elements that appear on the web), as well as the infrastructure used to provide such content and information, It is the exclusive property of RCD Mallorca or has the appropriate licenses for its use.

In addition, no intellectual or industrial property rights are assigned to the client on the website or on any of its component elements, being expressly prohibited the reproduction, transformation, distribution, public communication, making available, extraction, reuse, forwarding or the Use of any nature, by any means or procedure, of any of them, except in cases where it is legally permitted or authorized by the holder of the corresponding rights.

For any other use of the content of the Service you need our prior written consent.

6.2.- User content

As a user, you can contribute to the Service in various ways, such as sending emails, leaving comments or sending suggestions (hereinafter "Content").

We may use that Content in a number of ways, including displaying it on the website, reformatting it, translating it into other languages, editing it for clarity, correcting grammatical errors, creating derivative works from it, promoting it, and distributing it.

Therefore, the Content remains your property but by submitting it, you grant RCD Mallorca a license for worldwide, non-exclusive, free use, until the content is withdrawn, transferable and sublicensable on that Content.

7.- Product delivery and availability

We make deliveries throughout the Spanish territory, specifically the Balearic Islands, the Canary Islands, Ceuta and Melilla and the Iberian Peninsula and also to the rest of the European Union and international countries.

In any case, the delivery date to your home address may change depending on the availability of the chosen product, the warehouse of origin, the shipping area or the specific circumstances of each order. It can also change due to extraordinary incidents in the carrier, meteorological causes or any other type of analogous difficulties in the delivery of the merchandise. 

That said, the usual delivery times will be:

- Within 72 business hours after receipt of payment (Peninsula and Balearic Islands). If you want a tracking number, contact onlineshop@rcdmallorca.es

- For shipments to European countries, shipments will be delivered in 5-7 business days from receipt of payment.

- For international shipments outside of Europe, shipments will be delivered in 7-10 business days from receipt of payment.

Likewise, RCD Mallorca undertakes to deliver the goods purchased by the User, to the buyer's address indicated for this purpose in the order form (no products will be delivered to post office boxes or call centers), in the shortest possible time and , in any case, always before thirty (30) calendar days from the date of placing the order. The shipping costs of the purchased objects will be paid by the Buyer.

In any case, remember that deliveries are made every day of the week except Saturdays, Sundays and holidays and always during office hours.

On the other hand, if the purchased product is not available, the consumer will be informed of this through the web and it will not be able to be selected during the acquisition or purchase process. 

8.- Price and taxes

The prices of the products offered in RCD Mallorca are indicated in euros (€), with the Value Added Tax (VAT) in force at the time of purchase being recorded on the price of the products. 

In any case, the operation could be exempt or not subject to VAT depending on your country of residence or the condition in which you act. For this reason, in some cases the final price of the order may be altered with respect to the one shown.

The price of the products will be the one stipulated at all times on the website, except in the case of manifest error. Although RCD Mallorca tries to ensure that all prices on the website are correct, errors can occur. 

If an error is discovered in the price of the products that the customer has ordered, RCD Mallorca after informing you as soon as possible, will give you the option of reconfirming your order at the correct price or canceling it. If RCD Mallorca is unable to contact the customer, the order will be considered canceled and the amounts paid will be fully refunded.

RCD Mallorca is not obliged to supply products (even if the Shipping Confirmation has been sent) if the error in the price is obvious and unambiguous and could have been reasonably recognized by the customer as an incorrect price.

Given the particularities of online shopping, the price of the products indicated on the website refers solely and exclusively to the purchases made in it, without having to coincide with the sale price to the public of the RCD Mallorcaestablishments. In accordance with the foregoing, the price indicated on the website is only considered binding for online purchases and in no way links the RCD Mallorca.establishments.

Product prices may vary, but (except as stated above) possible changes will not affect orders with respect to which a Shipping Confirmation has already been sent.

Finally, the buyer undertakes to use the website diligently and in good faith, to pay the established price and is responsible for the veracity of the data provided required for the transaction.

9.- Shipping costs

A fixed amount is added to the prices indicated for each product for the shipping costs, indicated in each case during the purchase process. These expenses will always be paid by the buyer.

In that sense, shipping costs include handling and packaging costs, as well as postal costs. Handling costs have a fixed price, while transport costs may vary depending on the total weight of the package.

We advise you to group all your items in the same order. We cannot combine two different orders, and shipping costs will be applied for each one individually. We are not responsible for damage to your package after shipment, but we do our best to protect all fragile items. The boxes are large and your items will be well protected.

10.- Payment method

Payment of the products purchased must be made, in full, in advance and through:

• Credit and debit card VISA, Mastercard, Maestro, Amex

• Paypal

In this sense, RCD Mallorca informs credit and debit card holders that transactions in the online store are carried out through a secure payment gateway, using TLS technology to guarantee the security of data transmission.

11.- Right of withdrawal, returns and refunds

11.1.- Right of withdrawal

As a consumer, you will have a minimum period of fourteen calendar days to exercise your right of withdrawal. However, for this, the purchased product must not have been unsealed after delivery or used. 

In any case, you must notify us of your decision in a manner and form that allows us to verify that the products have been purchased in our store and that the term to withdraw from the contract is still in force.

Although it is not mandatory, you can use the model withdrawal form that we provide you in the Annex at the end of these terms and conditions.

Once the request has been confirmed, the carrier will contact you to specify the day and time of collection, without additional charges.

If you exercise your right of withdrawal, we will refund all payments received, including delivery costs, in a maximum of 14 calendar days from the date on which you inform us of your decision, as long as we have previously received the goods. or you have submitted proof of shipment, depending on which condition is met first. In any case, the direct costs of returning the goods must be borne by you.

We will make said refund using the same means of payment that you used for the initial transaction, unless you expressly indicate otherwise.

Despite the above, some of our products are made according to the user's specifications or clearly personalized, therefore the right of withdrawal will not be applicable according to article 103, letter c) of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.. 

11.2.- Returns and commercial guarantee

RCD Mallorca as the seller, will be liable for any lack of conformity that appears within a period of two years from delivery. In such cases, the consumer and user may choose between demanding repair (in the event that they were goods susceptible to repair) or replacement of the product, unless one of these two options is objectively impossible or disproportionate.

In cases where, due to the expenses involved in the repair or replacement, in relation to the value of the product, these are disproportionate, a price reduction will be offered.

For the exercise of this right, the consumer and user must inform the seller of the lack of conformity within a maximum period of two months from when they became aware of it and it must always be taken into account that the lack of conformity alleged and the moment in which it is claimed must be compatible with the nature of the product.

The exercise of this right will be free for the consumer. Both to exercise it and to request more information, contact us at onlineshop@rcdmallorca.es.

Once the request has been confirmed, the carrier will contact you to specify the day and time of collection, without additional charges.

On the other hand, if by mistake you were given a product other than the one requested, communicate it at onlineshop@rcdmallorca.es and the correct product will be delivered to you, picking up the first one, without any additional charge for you.

Returns of orders should be sent to the address Camí dels Reis, s / n, 07011 Palma, Illes Balears. Exercised by the buyer, RCD Mallorca will return the amounts received by payment, without any withholding, immediately and never within a period of more than thirty days.

Lasty, all customized product with printing (name and/or number), can not be returned, replaced, exchanged or refunded for others of a different or same size.

12.- Validity of the offers

The products offered by RCD Mallorca, and their prices, will be available for purchase while they are in the catalog of products displayed through this website. 

The offers will be properly displayed on the screen. RCD Mallorca reserves the right to decide, at any time, the products that are contained and offered to Users through the Website. In this way, RCD Mallorca may at any time add new products to those included on the Website, it being understood, unless otherwise provided, that such new products will be governed by the provisions of the Conditions of Use and Contract in force in that moment. 

In any case, RCD Mallorca reserves the right to make the modifications it deems appropriate in the Service, being able to update products and services depending on the market.

RCD Mallorca reserves the right to change prices without prior notice.

We inform you that despite the updates that are made to the prices of the Service, they could contain errors. We will promptly correct any errors that appear, but they will not be binding on the Service.

13.- Security

As indicated above, the entire purchase and sale procedure, as well as the transmission of your personal data and payment systems, is carried out on a secure page and in an encrypted form through the TLS protocol.

We guarantee the security of the Service in accordance with current technological knowledge. However, RCD Mallorca cannot guarantee the total future security of the Service. In any case, we do promise to correct and implement the appropriate corrective measures to correct a possible security breach as soon as possible.

You agree to notify RCD Mallorca, immediately and via email onlineshop@rcdmallorca.es, of any situation that could lead to the impersonation of a user's identity.

14.- Modifications and invalidity

We may update the terms and conditions of the Service in the future, as well as the features and functions of the Service itself.

We will inform you of the changes in terms and conditions by placing a notice in a prominent place on our website and / or by email.

If any clause included in these terms and conditions is declared, totally or partially, null or ineffective, it will only affect said provision or the part of it that is null or ineffective. The terms and conditions will subsist in everything else, having such provision, or the part of it that is affected, by not being placed.

In case of controversy, this Service is subject to the legislation and the courts of the consumer's domicile. 

 
If the person who contracted the Service did not have the legal status of a consumer, in the event of a dispute, the parties submit to the courts of Mallorca and to Spanish law.

In this sense, and according to the applicable regulations, RCD Mallorca informs of the existence of a European platform for the resolution of online disputes that facilitates the out-of-court resolution of such disputes for contracts also concluded online between consumers and Internet service providers.
